1. Acceptance of Terms

By accessing or using Africa Trade Market Agency’s website, mobile applications, or services (the “Platform”), you agree to be bound by these Terms of Service, our Privacy Policy, and any additional policies posted on the Platform.

If you do not agree, you must discontinue use immediately.

2. Platform Overview

Africa Trade Market Agency is a global B2B and B2C trade facilitation platform connecting exporters, importers, buyers, and sellers.

We provide digital tools for product listings, business matching, communication, payments, and logistics support. Africa Trade Market Agency acts as an intermediary and does not take ownership of goods.

3. Eligibility

To use the Platform, you must:

Be at least 18 years old
Have the legal capacity to enter into binding agreements
Operate a legally registered business (for business users)

Africa Trade Market Agency reserves the right to verify user identity and business credentials and to approve or reject any account at its discretion.

4. User Accounts

You are responsible for maintaining the confidentiality of your login credentials
You are responsible for all activities under your account
You must provide accurate and up-to-date information
Africa Trade Market Agency may suspend or terminate accounts involved in fraud, misrepresentation, or policy violations

5. Acceptable Use

You agree not to:

Use the Platform for illegal, fraudulent, or unauthorized activities
Misrepresent your identity, business, or products
Infringe on intellectual property rights
Upload or distribute false, misleading, or harmful content
Interfere with the security or operation of the Platform

6. Transactions and Payments

Africa Trade Market Agency is not a party to transactions between buyers and sellers
Payments are processed through authorized third-party providers (e.g., banks, fintech partners)
Users are responsible for compliance with all applicable laws, including taxes, customs, and trade regulations
Africa Trade Market Agency may charge service fees, commissions, subscriptions, or transaction fees, which will be disclosed in advance

7. Product Listings and Compliance

Sellers must:

Provide accurate and complete product descriptions
Ensure goods comply with applicable export/import laws and standards
Avoid listing counterfeit, restricted, or unsafe products

Africa Trade Market Agency reserves the right to remove or restrict listings that violate these Terms.

8. Shipping and Logistics

Shipping terms, costs, and timelines are agreed between buyers and sellers
Africa Trade Market Agency may facilitate logistics services but does not guarantee delivery outcomes
Africa Trade Market Agency is not liable for delays, damages, or losses during shipping

9. Dispute Resolution

Users agree to attempt to resolve disputes directly
Africa Trade Market Agency may offer mediation support at its discretion
Africa Trade Market Agency is not obligated to enforce dispute outcomes
Unresolved disputes may be referred to arbitration in accordance with the laws of British Columbia, Canada

10. Intellectual Property

All Platform content, software, branding, and trademarks are owned by Africa Trade Market Agency Solutions Inc.
Users retain ownership of their submitted content but grant Africa Trade Market Agency a worldwide, non-exclusive, royalty-free license to use, display, and distribute such content for Platform operations

11. Limitation of Liability

To the fullest extent permitted by law:

Africa Trade Market Agency provides the Platform on an “as is” and “as available” basis
Africa Trade Market Agency does not guarantee product quality, delivery, or performance by users
Africa Trade Market Agency is not liable for any direct, indirect, incidental, or consequential damages arising from Platform use
Users assume all risks associated with international trade

12. Indemnification

You agree to indemnify and hold harmless Africa Trade Market Agency, its affiliates, directors, and employees from any claims, damages, liabilities, or expenses arising from:

Your use of the Platform
Your violation of these Terms
Your breach of any applicable laws or third-party rights

13. Termination

Africa Trade Market Agency may suspend or terminate your account at any time for violations or risk concerns
You may terminate your account at any time by contacting us in writing
Upon termination, your right to access the Platform will cease immediately

14. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada.

Any disputes shall be resolved through arbitration or courts located in British Columbia, unless otherwise required by applicable law.

15. Changes to Terms

Africa Trade Market Agency may update these Terms from time to time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
